Our products are designed and intended for personal use only. By purchasing and using our condoms, you acknowledge that they must be used as directed for their intended purpose. We are not liable for any misuse or failure to follow instructions provided on our packaging and website.

2. Legal Compliance

Our condoms meet the safety and quality standards required under New Zealand law. However, it is your responsibility to ensure that purchasing and using our products aligns with your local laws and personal circumstances.

3. User Responsibility

The proper and effective use of our condoms is solely the responsibility of the user. This is not limited to but includes:

Checking the expiry date before use.
Following all instructions on our website and packaging.
Ensuring proper storage as per our recommendations.
Using condoms only for their intended purpose.
We are not responsible for any unintended consequences due to incorrect or negligent use.

4. Liability Disclaimer

While our condoms are manufactured to the highest standards, no contraceptive method is 100% effective in preventing pregnancy or sexually transmitted infections (STIs). We are not liable for any failure of the product due to improper use, user error, or any other circumstances beyond our control.

5. Pricing and Product Details

We do our best to ensure all product details, including pricing and specifications, are accurate. However, errors may occasionally occur. If a product is incorrectly priced and you place an order, we may contact you to offer the option to cancel your order for a full refund or proceed with the purchase at the correct price.

Product availability is subject to change. If an item is out of stock or you require a larger quantity than available, please reach out to our Customer Care team – hello@ohcleoh.com

Unless otherwise stated, all prices are listed in New Zealand dollars and exclude shipping, and any additional charges. Some payment methods may incur a surcharge, which will be clearly displayed at checkout.

Full payment, including any applicable shipping and taxes, is required at the time of purchase.

6. Delivery

Once your order is confirmed, we will select the most suitable shipping method to ensure prompt and safe delivery. Shipping fees are calculated and charged at checkout.

It is your responsibility to provide an accurate delivery address. If an incorrect address is provided, additional fees may apply for redelivery.

We work with third-party couriers, so shipping times may vary due to factors beyond our control. You will receive a tracking number (if applicable) to monitor your order’s progress. Once dispatched, we are not responsible for any transit damage.

7. Returns and Refunds

For hygiene and safety reasons, we do not accept returns or offer refunds on opened products. If you receive the wrong item or believe your product is faulty, please contact us with proof of purchase, and we will assess your request in line with the Consumer Guarantees Act 1993.

Returned products must be in their original, unopened packaging and untampered. We do not accept returns if you change your mind.

For public health reasons, please DO NOT return used products.

8. Privacy and Data Protection

We respect your privacy. Any personal information collected during the purchase process is handled in accordance with our Privacy Policy, which complies with the Privacy Act 2020 in New Zealand.

9. Intellectual Property

All branding, packaging, and website content are the property of Evolve Personal Care Ltd. You may not copy, reproduce, or distribute any materials without prior written consent.

10. Manufacturing and Compliance

We collaborate with trusted manufacturers and suppliers who share our commitment to quality and excellence. Our condoms are registered with MEDSAFE: New Zealand Medicines and Medical Devices Safety Authority.

We adhere to international safety and quality standards, including ISO 4074, as required by The Medicines Act 1981 and its regulations.

These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from these terms will be subject to the jurisdiction of New Zealand courts.

We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on our website, and continued use of our products or services constitutes acceptance of the updated terms.
